Policy Regarding Digital Millennium Copyright Act
Welcome to our website (referred to as the ‘Site’). We value and respect the intellectual property rights of others, just as we expect others to respect our rights. In accordance with the Digital Millennium Copyright Act, Title 17, United States Code, Section 512(c), a copyright owner or their representative can send a takedown notice to our DMCA Agent listed below. As an internet service provider, we are shielded from claims of infringement under the “safe harbor” provisions of the DMCA. To submit a valid claim of infringement to us, you must provide the following information:
Filing a Notice of Infringement Claim
- A signature from the copyright owner or an authorized representative;
- Identification of the copyrighted content that has been infringed;
- Details about the infringing material to be removed and how to locate it;
- Contact information for the complaining party, including name, address, email, phone number, and fax number;
- A statement confirming the belief that the material is being used without authorization;
- A statement of accuracy in the notification and affirmation of authorization to act on behalf of the copyright owner.
Under Title 17 USC §512(f), penalties are imposed for providing false information in a notification of infringement under 17 USC §512(c)(3).
Submit all takedown notices through our Contact page, preferably via email, for prompt processing.
Be aware that we may disclose the identity and information in any copyright infringement claim to the alleged infringer. By submitting a claim, you acknowledge and consent to this disclosure.
Submitting a Counter Notification for Restoration of Material
If you have received a notice of takedown due to a copyright infringement claim, you can send us a counter notification to have the material reinstated. The counter notification must be provided in writing to our DMCA Agent and must include the following elements per 17 USC Section 512(g)(3):
- Your signature;
- A description of the removed material and its original location;
- A statement, under penalty of perjury, that the removal was a mistake or misidentification;
- Your name, address, telephone number, and consent to jurisdiction for legal proceedings.
Send your counter notice via our Contact page, with email being the preferred method of communication.
Policy Against Repeat Infringers
